This privacy statement governs the manner in which Michigan Language Assessment collects, uses, maintains and discloses information collected from users (each, a “User”) of the michiganassessment.org website (“Site”). This privacy statement applies to the Site and all products and services offered by Michigan Language Assessment. The protection of your privacy and your personal data is important to us. Personal Identification Information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, place an order, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal-identification information, except that it may prevent them from engaging in certain Site-related activities.

Sometimes we might even need to hold special categories of personal data about you, for example information about your health. But we would only hold these special categories of personal data if it is necessary for us to carry out our obligations to you, such as to make special arrangements.

Purposes for Collecting Personal Data

We collect and use personal data to fulfil our contract to provide you with our tests, products, and services. Some uses of personal data include:

  • to develop, deliver, and process tests, including the collection, marking, and grading of exams, and the issuing of results and certificates
  • to develop and deliver materials you order such as practice tests
  • to make sure that appropriate facilities are available to those with specific needs
  • to check that you are who you say you are
  • to investigate allegations of misconduct
  • to handle complaints

We also use personal data for other legitimate activities that allow us to provide tests, products, and services, such as:

  • to carry out research to make sure our products and services are delivered to a high standard and that test takers are protected
  • to understand the needs of test takers and other users of our services
  • to provide training to people, such as teachers and examiners, in connection with our services
  • to maintain, safeguard, and improve our systems and record keeping

We may also use your personal data with your consent. By providing us with information, you consent to our collection and use of this information as described in this privacy policy. If you don’t consent to this privacy policy, please do not provide us with information on or through the Site. We require you to provide personal data to us so that we can enter into a contract with you to provide you with our tests, products, and services. If you refuse to give us some or all of the personal data, in some cases we may not be able enter into this contract to provide you with these.

We may use information you provide to carry out marketing and market research. We will only do this where you give permission to be contacted for these purposes. You can opt-out of these contacts at any time by notifying us at info@michiganassessment.org. We may also use your information in other ways that we describe when you provide the information or for other purposes with your permission.

We may sometimes use a method called profiling, which automates some parts of decision making, such as for marketing or when checking for cheating on our tests. Where we use profiling, a human being will still be involved in the decision making.

Children Under 16

Our Sites are not intended for children under the age of 16 years of age. No one under 16 can provide information to us on the Sites and we do not knowingly collect personal data from children under 16. If you are under 16, please do not provide any information to the Sites and request your parent or guardian provide it for you or provide us with appropriate permission to collect it from you. If we learn that we have collected or received personal data from a child under 16 without verification of your parents’ or guardians’ consent, we will delete that information. Nonpersonal Identification Information

We may collect nonpersonal identification information about Users whenever they interact with our Site. Nonpersonal identification information may include the browser name, the type of computer and technical information about Users’ means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web Browser Cookies

With your permission, our Site may use “cookies” to enhance your experience. Your web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. You may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

We may use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioural tracking). Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honour such signals and we do not modify what information we collect or how we use that information based upon whether such signal is broadcast or received.

How We Use Collected Information

Michigan Language Assessment collects and uses Users’ personal information for the following purposes

  • To improve our Site. We continually strive to improve our Site’s offerings based on the information and feedback we receive from you.
  • To improve customer service. Your information helps us to more effectively respond to your customer service requests and support needs.
  • To process transactions. We may use the information Users provide about themselves when placing an order to provide service to that order.
  • To send periodic emails. The email address Users provide for order processing, will only be used to send them information and updates pertaining to their order. It may also be used to respond to their inquiries, and/or other requests or questions.

How We Protect Your Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website[s], you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to our Sites. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites.

Sharing Your Personal Information

We do not sell, trade, or rent Users’ personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

In order to provide you with our products and services, we may share personal data

  • with the University of Michigan and the University of Cambridge and other affiliated businesses and organizations
  • with people and organizations that represent us, such as examiners and test centers
  • with other people and/or business who provide services on our behalf, such as payment processors and shipping companies
  • with schools or educational establishments which you attend
  • where we are required to do so by law
  • to someone who we buy or who we are sold to, or who we join with or who joins us, or in the event of bankruptcy when the personal data of our customers is amongst the assets that are transferred
  • for any other purpose when you explicitly ask us to if we believe disclosure is necessary or appropriate to protect us or someone else

Third-Party Websites

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

Other Information About Personal Data

We generally keep your personal data for an indefinite period after the last test that you take or the last time you request us to send information to a school or educational establishment. This allows us to verify candidate results from any time period. We may also keep your information for as long as necessary to comply with any legal requirements, and on our backup and disaster recovery systems in case we face a disaster. We occasionally keep your personal data as long as necessary to protect our legal rights, such as if we need to defend ourselves against a legal claim. Some of your personal data is aggregated or otherwise rendered anonymous so that you can no longer be identified – we keep this type of information forever.

You may ask us about your personal data that we have, request for any mistakes to be corrected, and tell us to stop using or erase your personal data at any time by writing to info@michiganassessment.org. We may not be able to accommodate your request if we believe it would violate any law or other legal requirement or if we believe it would cause the information to be incorrect. We will only erase your personal data when we no longer need it to fulfil our contract with you and when we no longer have any other legitimate activities related to your personal data. We also may not follow your request to erase your personal data if we believe the deletion would violate any law or legal requirement or cause the information to be incorrect. We also may not be able to delete your information that is in our backups until we no longer need those backups.

You can also ask us to restrict our processing of your personal data if you believe it to be incorrect, if it is determined that our processing was unlawful, or if we no longer are required to keep your personal data for processing, but we have kept it as permitted by law and we do not have any other purpose for keeping it. You can request this restriction at any time by writing to info@michiganassessment.org.

You can ask that we provide you a copy of any personal data that we hold about you that is based on your consent. You can also request that we send this information to another test taking organization, but only when we have the technical ability to do so. You can also withdraw your consent at any time by emailing us at info@michiganassessment.org. Withdrawing your consent will not, however, affect the any of the information we have already processed that was based on your consent before you withdrew it, and we may still process your data to fulfil our contract with you to provide or products, services, and tests or for other legitimate activities described above.

If you believe that we have violated your rights regarding our use of your personal data, you have the right to file a complaint with the supervisory authority in the country where you live, work, or where you believe your rights have been violated. However, before doing so we request that you contact us directly in order to give us an opportunity to work directly with you to resolve any concerns about your privacy.

If you contact us to exercise any of these rights, we may ask you for additional information to verify your identity. We may not be able to fulfil your request or we may limit your request if you have not provided us with enough information to verify your identity or to satisfy our other legal and business requirements.

Changes to This Privacy Statement

Michigan Language Assessment has the discretion to update this privacy statement at any time. When we do, we will revise the updated date at the bottom of this page. If we make material changes to how we use your personal data, we will notify you by email and/or through a notice on the Site’s home page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy statement periodically and become aware of modifications.

Data Controller and Contact Information

Michigan Language Assessment controls the purpose and use of your personal data and is the controller under data privacy laws in the EU. We have appointed a data protection officer and a representative in the EU in compliance with the laws in the EU. You may contact us, our data protection officer, or our representative through any of the methods listed below. If you wish to contact us, you must contact both us and our representative in the EU.

Consent to processing of personal data in the United States

Accordingly, your Personal Data may be transferred outside the country where you reside or are located, including to countries that may not or do not provide an adequate level of protection for your personal data.

We only transfer your personal data to another country if it is required or permitted under the applicable data protections laws and when there is appropriate safeguards to protect your personal data. By providing us information, you consent to storing and processing your personal data outside of the EEA. To ensure that your personal data is treated in accordance with this privacy policy, we also use Data Protection Agreements between Michigan Language Assessment and all other recipients of your personal data that may include, where applicable, Standard Contractual Clauses, which the EU Commission has determined provides for an adequate level of protection for your personal data. Your Acceptance of These Terms
By using this Site, you signify your acceptance of this statement and terms of service. If you do not agree to this statement, please do not use our Site. Your continued use of the Site following the posting of changes to this statement will be deemed your acceptance of those changes.
